One hundred years ago, most wars occurred between nations; today, large-scale violent conflict consists almost exclusively of civil wars in which civilians constitute 30 percent of casualties.’ According to a recent World Bank study of conflict, the poorest one-sixth of the worlds population suffers four-fifths of the consequences of civil wars. God is dead; but given the way people are, there may still for millennia be caves in which they show his shadow. – And we – we must still defeat his shadow as well!” – Friedrich Nietzsche[1] INTRODUCTION Friedrich Nietzsche famously declared that “God is dead!”[2] but lamented that his contemporaries remained living in the (...) shadow of God. For Nietzsche, the morality of his time was still based in the Christian tradition, even though faith in God was waning. Bioethics lives under a similar shadow: the shadow of Enlightenment Era-rationalism. Bioethics curricula focus on principles derived from Kantian deontology and utilitarianism. The allure of maintaining a moral framework that provides a rational method that can be handily applied to any situation remains strong. The principlist approach advanced by Tom Beauchamp and James Childress is taught to nearly all medical students in the United States,[3] and is essentially the canonical ethical framework of bioethics. In this model, the principle of autonomy is Kantian in nature, and the principles of beneficence and non-maleficence are utilitarian in nature.[4] Moreover, the presented framework is an approach that, when applied rationally to any healthcare scenario, will yield an outcome “considered moral.”[5] This reflects a faulty conception of philosophy that plagues much of bioethics, wherein the only contribution of philosophy pertinent to bioethics is moral philosophy elucidated by European thinkers in the Enlightenment Era. The landscape of moral philosophy has evolved significantly from the 18th century. However, the bioethical world has not kept up with the philosophical world, remaining instead in the shadow of antiquated moral thinking. Also lacking in bioethics are other disciplines of philosophy, such as philosophy of language, existentialism, and aesthetics, which are often given no consideration at all. The inclusion of both modern moral philosophy and other philosophical fields is necessary if bioethics is to survive its transition into modernity. l. The Shadow of Enlightenment Enlightenment Era philosophers such as Immanuel Kant argued that one need only employ reason to obtain knowledge; emotion bore no relevance when determining ethical behavior. Kant’s moral theories thus privileged a duty to act according to moral imperatives over feelings. Other Enlightenment Era philosophers such as John Locke developed systems that attempted to quantify human goods and human ills. This quantification potentially reduces human welfare and suffering to utility. Today, in the world of philosophy, such a “neutral analysis,” as Cora Diamond noted, is “dead or moribund.”[6] Bernard Williams remarked that such moral philosophy is “empty and boring,”[7] and G. E. M. Anscombe stated that it “no longer generally survives.”[8] And yet, just as the atheists in Nietzsche’s world dwelt in the moral code of a dead God, bioethicists still pursue a unified moral system that takes an input, applies some moral rules, and generates a moral outcome, like the four principles approach that Beauchamp and Childress laid out.[9] Some detractors of principlism take issue with their approach for not being unified enough and want to replace it with a procedural framework that is even more systematic and complicated. They argue that the resulting moral framework would be a “comprehensive decision procedure for arriving at answers”[10] that retains the “impartiality that is an essential part of morality.”[11] The shadow of rationalist morality has caused bioethical decision making to become detached and rigid when bioethics should concern itself with the humans whose lives it affects. A rational, divorced-from-emotion way of thinking ultimately fails to yield satisfactory results when decisions are made by and for emotional beings. Dr. Paul Farmer, among others, championed the idea that bioethics should be de-philosophized, as philosophy, cold and calculated, fails to adequately respond to the realities of those worst off.[12] Instead, Dr. Farmer emphasized the inclusion of the social sciences, like sociology and anthropology, in bioethics. Undoubtedly, Dr. Farmer was on the right track; bioethics should certainly engage directly with the people whom its decisions involve. If the narrow band of moral philosophy currently found in bioethics – that of stringent rationalism – were all that philosophy had to offer, I, too, would advocate for a de-philosophization. Ludwig Wittgenstein notes that to attempt to capture the complexity of moral thinking in a manner that employs reason alone and casts aside emotion is a “hopeless task,” like reconstructing a sharp image “from a blurred one.”[13] Unfortunately, bioethics is mired in the remnants of this hopeless task. To Dr. Farmer, the dominant moral framework was too restrictive and was unresponsive to the social and humanitarian needs of those whom bioethics is meant to help. As such, he wished to free bioethics from the shadow of a morality derived from rationalist thinkers. ll. Beyond Rationalism Like Nietzsche, who tried to resolve Europe’s post-religion vacuum by providing his society with a new way to live, Dr. Farmer wanted to replace the rationalist philosophy upon which bioethics was built with a “resocialization” of the field.[14] I agree with Dr. Farmer’s call for resocialization, as well as his denouncement of philosophy as it exists in bioethics. Evaluating risks and benefits along a predetermined array of moral principles is far too rigid and impersonal to guide what are often the most important decisions one will make. For Dr. Farmer, the most needed change was restoring the social element of bioethics. However, in advocating for this resocialization, Dr. Farmer casts philosophy as the antithesis of social science, noting that “few would regard philosophy … as a socializing discipline.”[15] I disagree. Rationalist moral philosophy may be lacking in socializing force, but there are other fields of philosophy that are responsive to our social reality. Rather than de-philosophizing bioethics, it makes more sense to replace the antisocial philosophies predominant in bioethics with prosocial philosophies better suited to it. Of course, the contribution of philosophy to bioethics is more than moral theories from the Enlightenment Era. There are more recent philosophical contributions from outside the field of moral philosophy that have roused bioethical interest. Jennifer Blumenthal-Barby, et al., argue for philosophy’s continued place in bioethics, citing Derek Parfit’s “non-identity problem,” which altered the landscape of reproductive ethics, and David Chalmers’ contributions to philosophy of consciousness, which have implications for the moral status of brain organoids.[16] Still, these are narrow applications of philosophy to highly specialized areas of bioethics, which not all bioethicists are inclined to delve into. Philosophy in bioethics should not be confined to niche applications in specialist fields but should influence all bioethical thought. Fortunately, there remains untapped a wealth of philosophical disciplines that pertains to exactly this. Philosophy of language investigates the nature of meaning and understanding in communication, which is a necessary social action. Successfully deciphering and conveying moral values in discourse is a bioethicist’s bread and butter, as is resolving disagreements and reaching agreements. Indeed, it is often the case that miscommunication lies at the root of an impasse between a doctor and a patient. An understanding of the nature of the disagreement would help resolve the conflict, as different types of disagreements require different interventions for resolution. For instance, a “substantive disagreement,”[17] in which two parties use the same terms in the same ways and have a fundamental disagreement on which outcome is more desirable, can be resolved only if one party yields to the other. On the other hand, a “merely verbal dispute,”[18] in which two parties use the same terms to represent entirely different concepts and values, requires standardization of terminological usage for its resolution. As such, no one can overstate the moral importance of successful communication in bioethics, and an exploration of language itself would prove invaluable to a bioethicist’s training. Existentialism is another subset of philosophy that acknowledges the social nature of human existence, noting that one’s being in the universe is concomitant with the existence of others sharing the same universe.[19] Thus, there is the recognition that whatever existence is, it is not complete without the existence of others. With this as a starting point, existentialists examined how to live meaningfully with others in this world. Since ethics crucially involves others, it is no surprise that existentialists pondered how to live moral lives. Existentialist conceptions of morality did not revolve around acting in accordance with a set of rules, but rather, recognized individual freedom in choosing how to act and emphasized acting authentically. In this vein, bioethicists should commit to doing what is right rather than committing to applying a set of principles. Existentialism, while part of the broader bioethics literature, is less common throughout bioethics curricula and deserves more prominence. Martin Heidegger, for instance, emphasized the difference between two types of thinking: “calculative thinking” and “meditative thinking.” Heidegger characterizes calculative thinking as a computation, wherein from some given starting conditions “definite results”[20] are determined, and contrasts this with meditative thinking, which he describes as “thinking which contemplates the meaning which reigns in everything that is.”[21] Heidegger was critical of the pervasiveness of calculative thinking, seeing it as the “ground of thoughtlessness,”[22] in which we only relate to the world in a meaningless, mechanical way. This is the emphasized type of thinking in rationalist conceptions of morality popular in bioethics; from a set of starting conditions, a series of rules are applied, and a moral outcome is calculated. Such a technique, however, discounts the personal meaning individuals place on the aspects of their lives relevant to their decision making, as well as the meaning in committing to doing what is right. Under calculative thinking, such a commitment is reduced to rote rule-following. A turn to meditative thinking would ensure that bioethical decisions comport with living meaningful lives. Even aesthetics, a discipline devoted to examining beauty and taste,[23] has a place in bioethics. Just as the viewing of a painting, the listening of a song, or the reading of a book elicits an effective response, hearing a patient’s story leaves an emotional imprint. The recounting of a traumatic moment imparts sadness, and a joyous occasion begets joy in the listener as well. As acknowledged in the field of everyday aesthetics, these aesthetic experiences often spur us to act:[24] The unsightly appearance of a polluted riverbank drives us to remove the trash; the presence of sorrow in one’s life drives us to ameliorate it. To be mindful of aesthetic experiences and allow them to affect us emotionally is paramount to the motivation of a bioethicist to serve the patient, not out of an obligation to a job description, but out of a desire to truly avail the patient of their anguish. For example, the new field of narrative medicine utilizes critical reading and literary techniques to train clinicians and bioethicists in emotional understanding and listening skills that stress the social aspects of medicine beyond rational analysis and decision making. CONCLUSION Dr. Farmer is absolutely correct; bioethics is in dire need of resocialization. It should not be the case that the justification for a moral action is essentially that “the rules say so,” or that simply by teaching such rules to medical students, the very act of making bioethical decisions that diverge from those determined by principles can be seen as an act of “bad faith … hubris or, worse, malpractice.”[25] As bioethicists are coming to realize, the rationalist philosophical traditions that bioethics was founded upon are past their expiry, and the time for change is now. Indeed, as Dr. Farmer urges, “socializing disciplines” like anthropology, history, political economy, and sociology are necessary to humanize the field of bioethics.[26] So too, however, can philosophy be a socializing discipline, if we know where to look. Bioethics should evolve. Its new goal should be to focus on meaningful human relationships, and to phase out rigid, impersonal modes of moral thinking. The limited sampling of unsatisfying moral theories from hundreds of years ago leaves many bioethics students cold, and it is easy to see why bioethicists are ready to part ways with philosophy. I believe this is a move in the wrong direction; there is a place for philosophy in the future of bioethics. Just as bioethics needs a resocialization, it is also needs of a re-philosophization. These enrichments complement one another. There is more to bioethics than mechanically determining the right course of action in a healthcare setting. Bioethics engages with the most ancient of philosophical questions: questions of what makes human existence meaningful, what makes us who we are, how we want to relate to others, how and why we feel, what our place in the world is, how we can communicate what we think, and why our moral intuitions are so compelling. Medicine and its allied health sciences have for too long been peripherally involved in work on human rights. Fifty years ago, the door to greater involvement was opened by Article 25 of the Universal Declaration of Human Rights, which underlined social and economic rights: “Everyone has the right to a standard of living adequate for the health and well-being of himself and his family, including food, clothing, housing, and medical care and necessary social services, and the right to security in (...) the event of unemployment, sickness, disability, widowhood, old age or other lack of livelihood in circumstances beyond his control.”. En este artículo abordamos las nociones de libertad, historia y subjetividad, con el fin de aportar una contribución original a los estudios sobre la ideología. Nuestra metodología consistirá en cruzar el psicoanálisis freudiano-lacaniano y la teoría de la interpelación de Louis Althusser. En la introducción, comenzaremos exponiendo dos grandes críticas al psicoanálisis freudiano, una formulada por Jean-Paul Sartre, y la otra por Gilles Deleuze y Félix Guattari, arrojando así la luz sobre cómo el psicoanálisis podría representar (a pesar de esos (...) argumentos críticos), un campo de libertad en lugar de determinismo, y un dominio que es inherentemente histórico, en lugar de lo contrario. En la primera sección, examinaremos más de cerca las nociones de libertad, memoria e historia, avanzando una hipótesis preliminar según la cual, dentro del espacio simbólico, el pasado permanece abierto a los cambios, lo que hará posible tanto la ideología como la libertad. Además, veremos qué aspectos de la libertad podrían encontrarse dentro de la teoría althusseriana de la interpelación, y cómo el psicoanálisis lacaniano es compatible con ella o puede llevarnos más allá de sus limitaciones. En la segunda sección, veremos cómo puede haber un sujeto que precede a la subjetivación, y cómo la teoría del sujeto de Lacan que surge del resto traumático, sobrepasa el alcance de la teoría de la interpelación. La tercera sección abordará el núcleo pulsional-traumático del sujeto, tal como lo concibe Freud, no sólo como dimensión determinante del psiquismo individual, sino como condición estructural de la cultura. A través de estas consideraciones, mostraremos cómo el psicoanálisis puede proporcionar una explicación de los fundamentos de la ideología, al concebir el núcleo pulsional-traumático de la ley que reside en el Nombre-del-Padre. En la conclusión, veremos, a través de una serie de ejemplos, cómo la ideología aparece disfrazada de verdad, y por qué la comprensión psicoanalítica del inconsciente es necesaria para desenmascarar las ilusiones que produce. Este artículo explora el concepto de trauma colectivo y su aplicación en el contexto histórico y social de las sociedades latinoamericanas. La transferencia del término «trauma colectivo» desde el campo del conocimiento psicológico a la esfera social e histórica plantea preguntas sobre su legitimidad y marco conceptual. El estudio examina la fidelidad de esta transferencia conceptual y su relación con la comprensión psicoanalítica temprana de los fenómenos traumáticos. El contexto cultural europeo de finales del siglo xix y principios del siglo (...) xx proporcionó la base para teorizar las consecuencias de experiencias intensas y violentas, lo que resultó en el concepto de «neurosis traumática», influenciado significativamente por el trabajo de Freud. El artículo discute la apropiación de herramientas psicoanalíticas en la crítica histórica y cultural para comprender eventos que desafían marcos tradicionales y la inteligibilidad social, como el Holocausto. La noción del trauma como una fuerza enigmática y recurrente en la experiencia histórica se explora a través del enfoque de los estudios del trauma. El artículo pone de relieve a destacados y destacadas académicas en este campo y su uso de conceptos psicoanalíticos, demostrando la preservación y aplicación significativa de estas nociones en la comprensión de fenómenos históricos y colectivos. Al acortar la brecha entre las experiencias psicológicas individuales y los traumas colectivos, los estudios del trauma ofrecen un enfoque único para interpretar y representar eventos que resisten las narrativas históricas tradicionales. El presente artículo contribuye a reflexionar en torno a los aportes que realizara la intelectual chilena Amanda Labarca en las hibridaciones entre filosofía y psicología, lo que permite discurrir hacia reflexiones y debates que se suscitan en el campo educativo en el tránsito del siglo XIX al XX. Se utilizó principalmente fuentes primarias para abordar diversos aspectos de la obra de Amanda Labarca y se recurrió a sus primeros trabajos vinculados a la educación y enseñanza. Se asignó relevancia a su (...) obra Lecciones de Filosofía (1922), la que siendo un texto eminentemente filosófico, a su vez, refleja los preludios de la psicología general y educativa en Chile, los cuales se presentan en un período de inmersión en el cual una joven Labarca estudió en profundidad y divulgó a los principales autores estadounidenses que forjaron los nexos entre ambas disciplinas (filosofía y psicología). This article aims to analyze the work Mal-entendido em Moscou, by Simone de Beauvoir from to specific themes: the aging and the finitude. The book tells the story of André and Nicole, two retired professors who feel the weight of aging and travel to the USSR for the second time in their life. Thus, a series of misunderstandings start taking place: the lack of communication, the fear of aging, a long-standing love, the assumption of female identity, their political expectations (...) and the difference between the characters’ comprehension of the world itself. In this text, I address these divergences, especially the impact of aging and the realization of finiteness by the main character and how these matters of uneasiness reverberate in all of us as well. The article is subdivided as follows; first it deals in general with the relationship between philosophy and literature in Beauvoir's production; the following presents the plot of the work, highlighting some important elements for the discussion and; finally, it investigates questions about aging and facticity, seeking to understand the original focus that the philosopher outlines in the courageous and realistic creation that she makes of her characters. I argue against the tendency in the philosophy of science literature to link abduction to the inference to the best explanation (IBE), and in particular, to claim that Peireean abduction is a conceptual predecessor to IBE. This is not to discount either abduction or IBE. Rather the purpose of this paper is to clarify the relation between Peireean abduction and IBE in accounting for ampliative inference in science. This paper aims at a proper classification—not justification—of types of scientific reasoning. In (...) particular, I claim that Peireean abduction is an in-depth account of the process of generating explanatory hypotheses, while IBE, at least in Peter Lipton's thorough treatment, is a more encompassing account of the processes both of generating and of evaluating scientific hypotheses. There is then a two-fold problem with the claim that abduction is IBE. On the one hand, it conflates abduction and induction, which are two distinct forms of logical inference, with two distinct aims, as shown by Charles S. Peirce; on the other hand it lacks a clear sense of the full scope of IBE as an account of scientific inference. (shrink)

The sense of agency is a central aspect of human self-consciousness and refers to the experience of oneself as the agent of one’s own actions. Several different cognitive theories on the sense of agency have been proposed implying divergent empirical approaches and results, especially with respect to neural correlates. A multifactorial and multilevel model of the sense of agency may provide the most constructive framework for integrating divergent theories and findings, meeting the complex nature of this intriguing phenomenon.

There is a growing realisation that the current upward trend in levels of disclosure of social, ethical and environmental performance by corporations and other organisations is not being accompanied by simultaneous greater levels of public trust. Low levels of confidence in the information communicated in public reporting is probably undermining the impetus for this disclosure. This article suggests that this credibility gap can be narrowed through the use of third party independent assurance. However, this is not an unqualified panacea. Much (...) verification and assurance practice itself has to date been of questionable robustness, reliability and consistency, and has been framed by financial assurance models that are inadequate for the broader, qualitative dimensions of social, ethical and environmental performance. The paper argues that there is need for a universal standard for the provision of assurance of social, ethical and environmental reporting, and indeed for the credibility of the assurance providers themselves. The new AA1000S Assurance Standard, developed by the Institute of Social and Ethical AccountAbility, offers an approach and a tool for addressing these gaps. (shrink)

Various authors debate the question of whether neuroscience is relevant to criminal responsibility. However, a plethora of different techniques and technologies, each with their own abilities and drawbacks, lurks beneath the label “neuroscience”; and in criminal law responsibility is not a single, unitary and generic concept, but it is rather a syndrome of at least six different concepts. Consequently, there are at least six different responsibility questions that the criminal law asks—at least one for each responsibility concept—and, I will suggest, (...) a multitude of ways in which the techniques and technologies that comprise neuroscience might help us to address those diverse questions. In a way, on my account neuroscience is relevant to criminal responsibility in many ways, but I hesitate to state my position like this because doing so obscures two points which I would rather highlight: one, neither neuroscience nor criminal responsibility are as unified as that; and two, the criminal law asks many different responsibility questions and not just one generic question. Although empirical evidence may provide a much desired sense of certainty amidst a pandemic characterised by uncertainty, the vast gamut of available COVID-19 data, including misinformation, has instead increased confusion and distrust in authorities’ decisions. One key lesson we have been gradually learning from the COVID-19 pandemic is that the availability of empirical data and scientific evidence alone do not automatically lead to good decisions. Good decision-making in public health policy, this paper argues, does depend on the availability of reliable (...) data and rigorous analyses, but depends above all on sound ethical reasoning that ascribes value and normative judgement to empirical facts. A bstract This study investigates nineteenth century natural history practices through the lens of the Actor-Network Theory, which posits that scientific practice is shaped by an intricate network of interactions between human and non-human actors. At the core of this research is the analysis of correspondence between Charles Darwin and his collaborators during the _Cirripedia Project,_ which unveils a complex landscape of negotiations with illustrators, funders, specimen owners, and translators, among other stakeholders and interested parties. The study goes beyond the (...) final outcomes of scientific research, delving into behind-the-scenes interactions, and hidden constructions, shedding light on the complex dynamics and actors that conventional scientific narratives often overlook. In general, this approach provides a detailed and insightful view of the underlying processes of nineteenth-century scientific practice, underscoring the importance of epistolary correspondence as a central element in producing scientific knowledge at the time, and in particular it reveals to us how much Darwin was himself involved in the production of his famous work on barnacles. By emphasizing the intricacies of research, this study enriches our understanding of Darwin’s work as well as natural history practices in the 19th century, highlighting the complexity and diversity of actors and agents involved in shaping scientific knowledge. El presente artículo tiene como objetivo determinar el fundamento teológico del concepto de soberanía propuesto por el jurista alemán Carl Schmitt. Según nuestra hipótesis, tal fundamento teológico se encuentra en la filosofía del pensador danés Søren Kierkegaard, quien, en diferentes obras, desarrolló los importantes conceptos de excepción, decisión y suspensión teleológica de la ética en relación a la experiencia religiosa de la repetición. Como veremos, tales conceptos forman parte del fundamento teológico de la famosa definición schmittiana de la soberanía: “soberano (...) es quien decide sobre el estado de excepción”, la cual define el decisionismo del jurista alemán. Así, por medio del concepto de decisión, extraído de la obra kierkegaardiana e introducido en la doctrina de la soberanía, Schmitt logra tres objetivos. Por un lado, no solo inicia la crítica al parlamentarismo liberal y al Estado burgués de Derecho, sino que revela el fundamento teológico-existencial de la unidad política del Estado moderno. En segundo lugar, en el marco jurídico-político, actualiza la teología fideísta desarrollada por Kierkegaard en su obra. Finalmente, en el marco teológico-metafísico, introduce el papel de la decisión como actualizador del rol público de la trascendencia en la modernidad secularizada frente a la reserva escatológica de la teología. Para lograr nuestro objetivo, utilizaremos el método de la analogía conceptual teológico-política creado y aplicado por el mismo Carl Schmitt a la historia de la soberanía europea. (shrink)

Este hecho, además de rescatar una parte de la cultura oral mapuche, demuestra la vigencia del proyecto evangelizador iniciado por el padre Luis de Valdivia. El artículo analiza la relación entre la escritura de los mitos indígenas (...) y el programa misional jesuita. Planteo que el rescate de las creencias nativas fue un medio para desestabilizar la legitimidad del discurso esclavista y para justificar una forma distinta de imponer las prácticas de sujeción colonial a partir de la idea de continuidad entre ambas culturas. Anti-exceptionalists about logic maintain that it is continuous with the empirical sciences. Taking anti-exceptionalism for granted, we argue that traditional approaches to explanation are inadequate in the case of logic. We argue that Andrea Woody's functional analysis of explanation is a better fit with logical practice and accounts better for the explanatory role of logical theories.

This commentary defines what shared yet differentiated ethical responsibilities to tackle antimicrobial resistance (AMR) mean, by introducing a threefold principled account of AMR global governance. It argues that the principles of solidarity, subsidiarity, and stewardship can be especially helpful for further justifying some of the universal, differentiated, and individual responsibilities that Van Katwyk et al propose. The upshot of my threefold principled account of AMR global governance is a less ambitious AMR treaty, one that can only justify (i) universal duties (...) of global coordination (as per the principle of solidarity); (ii) differentiated duties to local communities, which bear the primary AMR responsibilities (as per the principle of subsidiarity); and (iii) individualized duties for ensuring truthful, evidence-based, consistent, and timely shared accountable communication (as per the principle of stewardship). Garrath Williams claims that truly responsible people must possess a “capacity … to respond [appropriately] to normative demands” (2008:462). However, there are people whom we would normally praise for their responsibility despite the fact that they do not yet possess such a capacity (e.g. consistently well-behaved young children), and others who have such capacity but who are still patently irresponsible (e.g. some badly-behaved adults). Thus, I argue that to qualify for the accolade “a responsible person” one need not possess such (...) a capacity, but only to be earnestly willing to do the right thing and to have a history that testifies to this willingness. Although we may have good reasons to prefer to have such a capacity ourselves, and to associate ourselves with others who have it, at a conceptual level I do not think that such considerations support the claim that having this capacity is a necessary condition of being a responsible person in the virtue sense. This book seeks to arrive at a better understanding of the relationships between the objective and subjective aspects of time. It discusses the existence of fluent time, a controversial concept in many areas, from philosophy to physics. Fluent time is understood as directional time with a past, a present and a future. We experience fluent time in our lives and we adopt a temporal perspective in our ways of knowing and acting. Nevertheless, the existence of fluent time has been debated (...) for both philosophical and scientific reasons, thus creating a rift between the subjective and objective aspects of time. Starting from the basic notion of points of view, or perspectives, this book explores the relationships between objective or external time, as it has been conceptualized by science, and subjective or internal time, which is involved in our lived experiences. It establishes a general framework encompassing the nature, structure and mode of existence of points of view, in which the objective and subjective aspects of time can be integrated. The book mainly addresses researchers and postgraduates in philosophy and logic. Additionally, it offers inspiration for physicists and computer scientists involved in the modeling and simulation of complex behaviors for which the representation of internal time should be considered together with the notion of objective, external time. A heterogeneous survey sample of for-profit, non-profit and government employees revealed that organizational factors but not personal characteristics were significant antecedents of misconduct and job satisfaction. Formal organizational compliance practices and ethical climate were independent predictors of misconduct, and compliance practices also moderated the relationship between ethical climate and misconduct, as well as between pressure to compromise ethical standards and misconduct. Misconduct was not predicted by level of moral reasoning, age, sex, ethnicity, job status, or size and type of organization. (...) Demographic variables predicted job satisfaction and organizational variables added significant incremental variance. Results suggest the importance of promoting a moral organization through the words and actions of senior managers and supervisors, independent of formal mechanisms such as codes of conduct. (shrink)

“Mansplaining” is by now part of the common cultural vernacular. Yet, academic analyses of it—specifically, philosophical ones—are missing. This paper sets out to address just that problem. Analyzed through a lens of epistemic injustice, the focus of the analysis concerns both what it is, and what its harms are. I argue it is a form of epistemic injustice distinct from testimonial injustice wherein there is a dysfunctional subversion of the epistemic roles of hearer and speaker in a testimonial exchange. As (...) these are roles of power and are crucial to our existence and functioning within epistemic communities, the wrong and harms suffered from this injustice are serious and, I argue, distinct from other types already discussed in the literature. I close by considering an alternative model of mansplaining as a form of silencing, as well as briefly diagnosing its general underlying cause and possible solutions. (shrink)

Luck egalitarians think that considerations of responsibility can excuse departures from strict equality. However critics argue that allowing responsibility to play this role has objectionably harsh consequences. Luck egalitarians usually respond either by explaining why that harshness is not excessive, or by identifying allegedly legitimate exclusions from the default responsibility-tracking rule to tone down that harshness. And in response, critics respectively deny that this harshness is not excessive, or they argue that those exclusions would be ineffective or lacking in justification. (...) Rather than taking sides, after criticizing both positions I also argue that this way of carrying on the debate – i.e. as a debate about whether the harsh demands of responsibility outweigh other considerations, and about whether exclusions to responsibility-tracking would be effective and/or justified – is deeply problematic. On my account, the demands of responsibility do not – in fact, they can not – conflict with the demands of other normative considerations, because responsibility only provides a formal structure within which those other considerations determine how people may be treated, but it does not generate its own practical demands. Could neuroimaging evidence help us to assess the degree of a person’s responsibility for a crime which we know that they committed? This essay defends an affirmative answer to this question. A range of standard objections to this high-tech approach to assessing people’s responsibility is considered and then set aside, but I also bring to light and then reject a novel objection—an objection which is only encountered when functional (rather than structural) neuroimaging is used to assess people’s responsibility.

This paper argues that the existing definition of pandemics is not nuanced enough, because it is predicated solely on the criterion of spread, rather than on the criteria of spread and severity. This definitional challenge is what I call ‘the conflation problem’: there is a conflation of two different realities of global health, namely global health emergencies (i.e., severe communicable diseases that spread across borders) and nonemergencies (i.e., communicable or noncommunicable diseases that spread across borders and that may be severe). (...) To put this argument forth, this paper begins by discussing the existing and internationally accepted definition of pandemics, its requirements, as well as its strengths (section 1). Section 2 then considers the problem with the standard definition of pandemics (i.e., the conflation problem) and some examples of it. Finally, section 3 evaluates some practical implications of the conflation problem to then explore conceptual clarity as the adequate solution. (shrink)

What, if anything, do we owe others as a basic minimum? Sufficiency theorists claim that we must provide everyone with enough – but, to date, few well-worked-out accounts of the sufficiency threshold exist, so it is difficult to evaluate this proposition. Previous theories do not provide plausible, independent accounts of resources, capabilities, or welfare that might play the requisite role. Moreover, I believe existing accounts do not provide nearly enough guidance for policymakers. Fred Adams and collaborators advocate a view on which empty-name sentences semantically encode incomplete propositions, but which can be used to conversationally implicate descriptive propositions. This account has come under criticism recently from Marga Reimer and Anthony Everett. Reimer correctly observes that their account does not pass a natural test for conversational implicatures, namely, that an explanation of our intuitions in terms of implicature should be such that we upon hearing it recognize it to be roughly correct. Everett argues that (...) the implicature view provides an explanation of only some of our intuitions, and is in fact incompatible with others, especially those concerning the modal profile of sentences containing empty names. I offer a pragmatist treatment of empty names based upon the recognition that the Gricean distinction between what is said and what is implicated is not exhaustive, and argue that such a solution avoids both Everett's and Reimer's criticisms. Most of the world's health problems afflict poor countries and their poorest inhabitants. There are many reasons why so many people die of poverty-related causes. One reason is that the poor cannot access many of the existing drugs and technologies they need. Another, is that little of the research and development (R&D) done on new drugs and technologies benefits the poor. There are several proposals on the table that might incentivize pharmaceutical companies to extend access to essential drugs and technologies (...) to the global poor.1 Still, the problem remains – the poor are suffering and dying from lack of access to essential medicines. So, it is worth considering a new alternative. This paper suggests rating pharmaceutical and biotechnology companies based on how some of their policies impact poor people's health. It argues that it might be possible to leverage a rating system to encourage companies to extend access to essential drugs and technologies to the poor. (shrink)

It has become standard for feminist philosophers of language to analyze Catherine MacKinnon's claim in terms of speech act theory. Backed by the Austinian observation that speech can do things and the legal claim that pornography is speech, the claim is that the speech acts performed by means of pornography silence women. This turns upon the notion of illocutionary silencing, or disablement. In this paper I observe that the focus by feminist philosophers of language on the failure to achieve uptake (...) for illocutionary acts serves to group together different kinds of illocutionary silencing which function in very different ways. In this paper I argue that Beall and Restall's claim that there is one true logic of metaphysical modality is incompatible with the formulation of logical pluralism that they give. I investigate various ways of reconciling their pluralism with this claim, but conclude that none of the options can be made to work.

Anyone familiar with The Economist knows the mantra: Free trade will ameliorate poverty by increasing growth and reducing inequality. This paper suggests that problems underlying measurement of poverty, inequality, and free trade provide reason to worry about this argument. Furthermore, the paper suggests that better evidence is necessary to establish that free trade is causing inequality and poverty to fall. Experimental studies usually provide the best evidence of causation. So, the paper concludes with a call for further research into the (...) prospects for ethically acceptable experimental testing of free trade's impact on poverty and inequality. Although the paper is unabashedly methodological, its conclusions bear on many ethical debates. Ethicists sometimes argue, for instance, that there is reason to encourage free trade because they believe free trade is decreasing poverty and inequality. Clarifying the empirical facts may not settle ethical debates but it may inform them. (shrink)

A theory of intergenerational justice consists in the study of the moral and political status of the relations between present and past or future people, more specifically, of the obligations and entitlements they can potentially generate. The challenges that justify talking about responsibilities between generations are myriad. And the disputes they prompt can focus on the past just as much as on the present, even though the fact that the human species has reached a state of technological progress that enables (...) it to have an irredeemable impact on the planet and perhaps even endanger future human existence tends to make concerns about the future more pressing. Debates on intergenerational justice are twofold. The first revolves around the issue of whether claims of justice across generations whose members' lifetimes do not necessarily overlap could be justified. And the second revolves around the specific conception of justice in play, that is, around the nature of the standard that must be applied as well as around the identification of the contents of the duties that present generations supposedly have vis-à-vis past or future generations. This survey article depicts the conceptual and argumentative framework in which these debates are set. It aims to outline certain of the main features shared by the most influential contemporary theories of intergenerational justice, and the problems inherent in them. It concludes by suggesting that, even though the idea of succeeding generations is merely an abstraction, there are specific empirical states of affairs that require different theoretical responses to intergenerational justice. Resumo Este artigo defende o ponto de vista de que as bases da ciência cognitiva contemporânea estão em sintonia com o pensamento de Merleau-Ponty, em seus aspectos antiobjetivista e antirrepresentacionalista. A ideia de representação mental é contestada, tanto na CC quanto no pensamento de Merleau-Ponty. A cognição não espelha um mundo exterior independente dos sujeitos incorporados. O mundo é um existencial, como afirmam Merleau-Ponty e a CC. A hipótese da representação mental supõe que o mundo pode ser percebido de forma (...) independente do sujeito que percebe. Isso não é verdade. A percepção depende da forma como o sujeito age em seu mundo percebido. Todas as estimulações que o organismo encontra só são possíveis pelos seus movimentos precedentes que resultam na exposição do órgão receptor às influências externas. Os estímulos sensoriais que o organismo encontra dependem diretamente do seu comportamento motor e a forma como o organismo se move depende diretamente das consequências sensoriais dos seus comportamentos anteriores.This article defends the view that the foundations of contemporary cognitive science are in tune with Merleau-Ponty’s thinking in its anti-objectivist and anti-representationalist aspects. The idea of mental representation is contested both in CC and in Merleau-Ponty’s thinking. Cognition does not mirror an outside world independent of embodied subjects. The world is an existential one as Merleau-Ponty and the CC say. The mental representation hypothesis assumes that the world can be perceived independently of the perceiving subject. This is not true. Perception depends on how the subject acts in his perceived world. All the stimulations that the organism finds are only possible by its previous movements that result in the exposure of the receiving organ to external influences. The sensory stimuli that the organism finds depend directly on its motor behavior and the way the organism moves depends directly on the sensory consequences of its previous behaviors. (shrink)

​The traditional datum concerning moral testimony is that it is (epistemically or morally) problematic--or at least more problematic--than non-moral testimony. More recently, some have sought to analyze the issue of moral testimony within a narrower lens: instead of questioning whether moral testimony on the whole is (more) problematic or not, they have instead focused on possible conditions under which moral deference would be legitimate or forbidden. In this paper, I consider two such features: that of uncertainty and a belief in (...) the greater reliability of another agent. I argue that under these conditions agents have a moral obligation not to defer. I argue that this is because uncertainty and judgments of others’ reliability covary with social status and are themselves products of oppressive social hierarchies, in which case moral deference under these conditions would result in many harms, the most significant being that it would itself propagate oppression by perpetuating unjust social hierarchies. In this way, this paper focuses on how unjust social facts can affect our moral epistemology, specifically how social and political factors can affect moral testimony, and is thus an exercise in non-ideal moral epistemology.
